Will anything ever be Spencer's fault?

Summary of the Court Document
This is a 2010 opinion from the Missouri Court of Appeals, Southern District, Division Two, in the case State of Missouri v. Robert Benedict, No. SD 29822 (decided August 20, 2010). Judge William W. Francis, Jr. authored the opinion.
Key Outcome
  • The court affirmed the trial court’s judgment.
  • Robert Benedict (“Appellant”) was convicted by a jury of:
    • Second-degree statutory rape (Mo. Rev. Stat. § 566.034)
    • Second-degree statutory sodomy (Mo. Rev. Stat. § 566.064)
  • He was sentenced to two concurrent five-year prison terms.
Facts of the Case
  • In January 2006, Benedict (then age 40) began a sexual relationship with K.W., a 14-year-old girl.
  • The relationship involved sexual intercourse and oral sex, occurring approximately once a week until the fall of 2006.
  • K.W. explicitly told Benedict her age at the start.
  • They communicated via emails, text messages, and cell phones.
  • K.W.’s mother discovered incriminating emails and pictures on her daughter’s phone and reported it to police.
  • Benedict was subsequently charged and convicted of the two felony sex offenses.
Procedural Note
The opinion briefly discusses the defense counsel’s access to the prosecutor’s file under Missouri’s open-file policy in early 2008, but the visible portion of the document cuts off mid-sentence in that section.
Bottom line: The appeals court upheld Benedict’s convictions and sentences for having a sexual relationship with a 14-year-old minor when he was 40.
