Henry:

Looks like I emailed it directly to the interim city manager and did not include the city clerk, which is probably why the city did not have a copy.  The Development Agreement does state that is goes to the city manager.  I was likely traveling which is why I sent it in a different method.

January 25, 2024

Robert Nienstedt, Interim City Manager

via email

City of Topeka

215 SE 6th St. #352

Topeka, KS 66603

City Manager,

Pursuant to Section 9(b) and 9(d) of the Development Agreement between 29 Fairlawn, LLC and the City of Topeka, please accept this correspondence as the annual report of the project known as Wheatfield Village.

As a summary, Buildings 1, 2, 3, 4 & 5 are complete and have been placed in service.

At this time, the Developer continues to have the following lenders:

  1. Incentive Loan – Interstate Bank
  2. Buildings 3 & 4 (Restaurants) - CoreFirst Bank & Trust
  3. Building 5 (Theatre) – Oakstar Bank
  4. Building 1 (Hotel)  – Emprise Bank
  5. Building 2 (Apartment) – Equity Bank (Real Estate and Incentive Loan)

The Developer has submitted certifications for TIF, CID and Half-Cent Sales Tax and is preparing the certification of the eligible construction expenses associated with Wheatfield Apartments as the final construction items are completed with closed with the general contractor.

Further the applicable certificate of insurance is included in this submission.

If the City of Topeka has any additional questions, please feel free to reach out to me as we would be happy to discuss any outstanding issues.

Sincerely,

Jennifer Sourk

General Counsel

I will send it in the morning when I get to the office. All you had to do is ask the right source!   While you wait, I can tell you it says nearly the exact same thing as 2024, possibly different certification numbers and likely a comment about Wheatfield Apartments place in service date.

Good evening Henry,

I can confirm that 29 Fairlawn, LLC is in compliance and timely submits an annual report and typically with a certification.

I understand the city could not locate such report, however, it does not mean it was not submitted.

Mr. McClure,

The document that has been provided to you dated January 2025 reports 2024 data.

As a curtesy, we expanded the search and attached the next most recent report on file dated January 2023 reporting 2022 data. We have nothing else that is responsive to your request for the last 2 years' worth of financial reports related to Wheatfield Village.

Thank you.
