Please be advised that after receiving payment for the $25 assessed below, the Clerk has been working on pulling the records maintained in that office and will be provided when complete. For the remaining requests, IT staff has estimated 2 hours will be needed to run searches for responsive correspondence. Once that search is complete, a legal review of the documents produced by the search will be conducted.  Without knowing the number of documents the results will produce, it is difficult to estimate how much time will be needed for that legal review. For now, are estimating 3 hours.  Staff time for IT and Legal Review is set at $35.00 per hour.  To commence this search, please submit prepayment in the amount of $175.00 to the City Clerk's Office. Once IT staff runs the search and provides the results for Legal to review, if needed, we will update the estimated time and cost for Legal Review.

This email is in response to your records request below. Topeka Municipal Code § 2.10.030 through § 2.10.130 establishes procedures and costs for open records requests. (See the fee schedule here.)

 

The Clerk's Office estimates one hour is needed to gather and produce the requested agreements, contracts, resolutions and meeting minutes.  This will be assessed at the $25.00 per hour rate.

 

Please be advised that we cannot search for "other LLCs."  If you'd like to provide us names of other LLCs, we will include those in our search.

 

In order to complete a thorough search for correspondence or other documents, we will need to coordinate with other department staff so we can provide a time and cost estimate for this portion of the request. We will follow up with that estimate no later than May 2.

 

If you would like the Clerk's Office to commence gathering the documents listed above, please submit payment of $25.00 to the City of Topeka. Payments can be mailed to my attention at the address below or made in person or by phone through the City Clerk's Office (785-368-3941).

Subject: Kansas Open Records Act (KORA) Request

 

Dear City Clerk,

Pursuant to the Kansas Open Records Act (K.S.A. 45-215 et seq.), I am requesting access to and copies of public records maintained by the City of Topeka. Specifically, I seek the following documents:

  • Any and all agreements, contracts, or memoranda of understanding between the City of Topeka, Jim Klausman (or his affiliated companies, including but not limited to Klaton Real Estateand other LLC's), and CoreFirst Bank & Trust concerning the Lauren's Bay subdivision, particularly those addressing tax responsibilities, special assessments, or property tax exemptions for lots in the subdivision.
  • Any resolutions, meeting minutes, or correspondence from 2015 to the present related to negotiations or agreements with Jim Klausman or Klaton Real Estate regarding back taxes, special assessments, or tax incentives (e.g., Community Improvement District or Reinvestment Housing Incentive District) for the Lauren's Bay subdivision.
  • Any documents referencing a deal or arrangement that releases or modifies Jim Klausman's (or his companies') obligation to pay property taxes or special assessments for properties in the Lauren's Bay subdivision.

Please include records in any format, including written, electronic, or photographic, made, maintained, or kept by the City of Topeka. If any records are exempt from disclosure, please provide a written explanation citing the specific legal basis for the exemption, as required by K.S.A. 45-218.

I request that the records be provided in electronic format (e.g., PDF) via email to [Your Email Address] if possible.
