REPORT REVEALS 30,000 NON-CITIZENS ON US VOTER ROLLS

A recent report from Reuters reveals that more than 30,000 non-citizens have been registered to vote across the United States, exposing a massive vulnerability in our election system that the radical Left refuses to acknowledge. In this edition of the Proctor Election Report, I will discuss the number of non-citizens registered to vote here in Kansas, the practical solutions I have passed to remove them from our voter rolls, and why we must pass the Citizens-Only Voting Amendment to protect our elections against left-wing lawfare.

“US states may have added more than 30,000 self-declared non-citizens to the nation's voter rolls since 2000 because of software glitches and clerical errors made while processing their driver's license and state ID applications, according to official records reviewed by Reuters...

“New Jersey announced the most recent high-profile case of errant voter registrations over the summer, saying a technology glitch added about 6,600 non-citizens ​to voter rolls between June 2023 and June 2024, even though they answered 'no' when asked if they were citizens while applying for licenses and IDs.

“Bureaucratic errors have also been reported in at least 11 other states – including Republican strongholds like Iowa, Texas and South Dakota - bringing the nationwide figure above 30,000 since 2000, according to the Reuters reporting.”

For years, the radical Left and their allies in the media and among House Democrats told us that non-citizen voting was a myth. They claimed our efforts to secure the voter rolls were a solution in search of a problem. Now, the truth is undeniable. Using data from the Center for Election Innovation and Research, Reuters recently reported that over 30,000 self-declared non-citizens have been registered to vote across the country. And this is not just happening in places like California or New York. It is happening right here in Kansas.

As Chairman of the House Elections Committee, I heard direct testimony from the Secretary of State's office confirming that as many as 80 non-citizens were registered to vote in our state. The Secretary of State is currently investigating whether as many as 20 of those individuals actually cast a ballot. To date, the Attorney General has prosecuted or is prosecuting four non-citizens for voting illegally in Kansas elections, including the former mayor of Coldwater who pleaded guilty to voting for decades without being a United States citizen.

“'I believe the number is four cases have been filed,' Kobach told reporters after a Sept. 8 press conference in Topeka. 'One of the things we were reviewing with our criminal division before I came over here was a whole bunch of other noncitizen voting cases.

“'We don't prosecute every one, every time there is a noncitizen who has voted. Sometimes we will look at the situation, and if it looks like the individual was not willfully doing so or if there's some mitigating factor, we won't file that case.

“'So the four is really the tip of the iceberg. Those are the ones that clearly the individual knew what he or she was doing; we believe we would get a guilty verdict if the case went to trial.'”

Now that we are catching non-citizens voting in our elections, the radical Left has changed their tune. They no longer say it is a myth. Now they claim it is just "exceedingly rare." But how many is too many? Every time a non-citizen casts a ballot, they cancel out the valid vote of a United States citizen. They are disenfranchising you. One illegal vote is one too many.

That is why, last year, I led the fight to pass common-sense safeguards to find and remove non-citizens from our voter rolls. We passed House Bill 2020 to require the Department of Motor Vehicles to share a list of non-citizens who receive temporary driver's licenses with the Secretary of State every quarter.

Last year, the Kansas House of Representatives passed House Bill 2020, a bill I introduced as the Chair of the House Committee on Elections to require the DMV to share the data it collects on non-citizens with the Kansas Secretary of State's Office so they can find and remove non-citizens from the voter rolls.

This year, I fought to pass the SAVE Kansas Act over the governor's veto. This critical law requires the state Medicaid, food stamp, and welfare offices, which are required by federal law to ask recipients if they want to register to vote, to share their lists of non-citizens receiving public benefits with the Secretary of State quarterly. It also requires the Secretary of State to upload our voter rolls to the federal Systematic Alien Verification for Entitlements (SAVE) database twice a year to find and remove non-citizens from our voter rolls.

The radical Left wants to keep our voter rolls vulnerable, but we are fighting back to ensure every legal vote counts. I am proud to have carried and passed the SAVE Kansas Act, a critical piece of legislation that combines three vital measures to clean up our registration records. Not only does this bill give us the tools to remove disqualified individuals from the rolls, but it also includes the crucial safeguards of HB 2491 and HB 2438. By requiring quarterly reports of noncitizens receiving public benefits, we can verify our rolls to prevent illegal voting. Furthermore, it shuts down third-party vulnerabilities by restricting online voter registration strictly to official .gov domains or websites approved by the Secretary of State. Without these combined protections, our election system remains wide open to exploitation. Activist groups fought hard against this bill to keep those loopholes open, but we successfully passed this report in the House to protect the integrity of Kansas elections.

These are practical solutions to ensure that only eligible citizens participate in our elections. Predictably, the Axis of Ballot Harvesting is striking back. The ACLU and the League of Women Voters, awash in dark money, are preparing to sue to block the SAVE Kansas Act. They want to keep our election system vulnerable so they can put their thumb on the scale.

We cannot allow left-wing activist groups to subvert our election system through the courts. To protect these laws, we must pass the Citizens-Only Voting Amendment this November. Right now, our state constitution does not explicitly state that you must be a citizen to vote. This is a massive vulnerability that activist judges could exploit to strike down our laws to combat non-citizen voting. Enshrining the simple principle that only US citizens should be allowed to vote in our constitution will protect our laws from activist courts and guarantee that voting remains a right reserved exclusively to citizens.

I recently joined John Whitmer on KNSS radio to discuss the urgent need to pass the Citizens-Only Voting Amendment this November. My opponent, California Democrat Jennifer Day, is on video wishing Kansas allowed non-citizens to vote--and there is zero chance she will defend the SAVE Kansas Act when her friends at the ACLU sue to tear it down. If I have the honor of your vote for Secretary of State, I will fight back against this Left-Wing Lawfare and ensure only citizens vote in Kansas!

Restoring confidence in our elections means ensuring that every legal vote, and only legal votes, are counted. I'll check the City of Topeka planning sources, permit portals, Planning Commission materials, and local coverage for anything new since the usual public updates.The portal launch and the September Planning Commission data-center amendments are the main official items so far. Next I’ll pull the latest weekly report, October agenda, and public permit search.October’s Planning Commission packet is not posted yet. I’m checking the live permit portal, the permits map, and the Sept. 30 portal update next.No new commercial, multifamily, industrial, mixed-use, plat, CUP, rezoning, or annexation cases are posted since the September Planning Commission meeting. Public permit search is effectively dark during the Tyler EP&L switch.

### What is new (process, not projects)

Public search of recent applications is not available without login. The search path redirects to authentication. Contractor licenses and some inspections are still incomplete; those still go to Trade Permits (785-368-3905 / inspections@topeka.org) or Building Permits (785-368-3704 / dspermits@topeka.org).

On September 30 the City said the new system erroneously emailed about 3,500 prior applicants. Recipients were told to disregard those messages. The building permits map at maps.topeka.org/BuildingPermits/ did not resolve. No September or October Development & Growth Management monthly PDF is posted. The latest statistical report is still the year-to-date run of September 1, 2026: 389 permits, about $271.5 million valuation, 311 residential units. Commercial additions/alterations dominate that total (93 permits, about $172.2 million). New five-or-more-family is only 2 permits / 10 structures / 224 units / about $46.3 million.

### Planning Commission
September 21 was discussion only. No action items, no new case numbers, no valuations.

- ACZR26/05: draft definitions and standards for data centers and energy storage. Not an application. The City’s 12-month moratorium (Ordinance 20670, July 14, 2026; clarified by 20677 on August 11) still blocks acceptance, processing, and approval of data-center applications, including city utility connections inside and outside the city.
- ACZR26/04: broader use-table and definition amendments.
- CPA26/02: Land Use & Growth Management Plan 2040 update (text and maps since the 2015 adoption).

- Data centers: nothing new inside the city. The county item in the September 9 staff memo is Compass Datacenters’ CUP on about 600 acres west of US-75 and south of SW 77th (site cited locally as 3303 SW 77th, Wakarusa). Filed July 24; staff memo said Shawnee County deemed it complete as of September 9, with no public hearing scheduled then. City procurement RFP 105, Independent Data Center Subject Matter Expert and Technical Advisory Services, closes October 9, 2026, 2:00 p.m.
- 37th & Gage / Eveningside: no new filings.
