Dear Mr. McClure,
 
We apologize for the delay in processing your KORA. The volume of potentially responsive emails required more time than initially anticipated to process. The three hours of staff time that you prepaid for has been used plus seven additional hours that the City is waiving charges for due to the delay and because we wanted to better understand how much additional time would be needed to finish filling your request. 
 
The time was spent reviewing potentially responsive emails from Braxton Copley's inbox. Please find the responsive documents linked here: https://cityoftopeka.sharefile.com/d-s230fc33695034f0988dc76c84a5eb8d7. Documents that are exempt from production pursuant to K.S.A. 45-221(a)(2), KSA 45-221(a)(20), and KSA 45-221(a)(21) have been withheld.
 
Additional staff time is needed to review approximately 1900 more potentially responsive emails in Mr. Copley's Sent folder and the other mailboxes that you identified. Staff time for Legal Review is set at $35.00 per hour and it is estimated that it will take an additional 40 hours of staff time to review the remaining 1900 emails. While some of these emails might be duplicative of each other, we still have to review each one and unfortunately the City's current system is mostly manual. 

We recognize that this represents significant time and cost. If you want to narrow the request to try to reduce the review time and cost, we'd be happy to work with you. If you prefer to move forward with the full request, please submit payment of $1,400 to the City of Topeka and upon receipt of payment the requested records will be provided to you. Payments can be mailed to my attention at the address below or made by phone through the City Clerk's Office at (785) 368-3941.

Subject: Kansas Open Records Act (KORA) Request



Dear City Clerk,

Pursuant to the Kansas Open Records Act (K.S.A. 45-215 et seq.), I am requesting access to and copies of public records maintained by the City of Topeka. Specifically, I seek the following documents:

  • Any and all agreements, contracts, or memoranda of understanding between the City of Topeka, Jim Klausman (or his affiliated companies, including but not limited to Klaton Real Estateand other LLC's), and CoreFirst Bank & Trust concerning the Lauren's Bay subdivision, particularly those addressing tax responsibilities, special assessments, or property tax exemptions for lots in the subdivision.
  • Any resolutions, meeting minutes, or correspondence from 2015 to the present related to negotiations or agreements with Jim Klausman or Klaton Real Estate regarding back taxes, special assessments, or tax incentives (e.g., Community Improvement District or Reinvestment Housing Incentive District) for the Lauren's Bay subdivision.
  • Any documents referencing a deal or arrangement that releases or modifies Jim Klausman's (or his companies') obligation to pay property taxes or special assessments for properties in the Lauren's Bay subdivision.

Please include records in any format, including written, electronic, or photographic, made, maintained, or kept by the City of Topeka. If any records are exempt from disclosure, please provide a written explanation citing the specific legal basis for the exemption, as required by K.S.A. 45-218.

I request that the records be provided in electronic format (e.g., PDF) via email to [Your Email Address] if possible. If electronic delivery is not feasible, please mail the records to the address listed above. I understand that fees may apply per TMC 2.20.130 (e.g., $0.25 per page for black-and-white copies) and agree to pay reasonable costs for copying and staff time, not exceeding actual costs.
