Proposed Administrative Regulations

K.A.R. 86-1-5 and 86-1-10. A public hearing will be conducted in-person and virtually on Monday, November 18, 2024, at 9:00 a.m. at the Kansas Real Estate Commission, 700 SW Jackson, Suite 404, Topeka, KS to review and consider the adoption of proposed permanent regulations of the Kansas Real Estate Commission. What Box Should I Check?

Are you disclosing your brokerage relationship with your client or customer correctly? Some purchase contracts include check boxes to disclose brokerage relationships. These are often filled out incorrectly.

If you are the only licensee involved in the transaction, you can only act in one capacity. Your relationship with both the seller and the buyer is the same. You cannot represent both sides in a transaction since it would result in dual agency which is not allowed per K.S.A. 58-30,103(a). For example, if you have a seller agency agreement with no designated agent, you would check the box indicating seller's agent on both sides. In this scenario, you are acting as a seller's agent for the seller and assisting the buyer as a seller's agent. 

If you have an agency agreement with a designated agent named, be sure to check the box for designated seller agent or designated buyer agent, whichever the case may be. The purchase contract and agency agreement must agree.

When drafting the purchase contract, you need to know how all licensees involved are acting in the transaction to fill out this section correctly. K.A.R. 86-3-26a(c) states that each licensee involved in a transaction as a statutory agent or a transaction broker shall ensure the completeness and accuracy of the disclosure required by K.S.A. 58-30,110(c).

Madison (Sawyer) Collazo is the Administrative Officer at KREC since June 2024. She answers the phones, processes course completion submissions for the education department, develops education materials, assists in the planning for Commission meetings, and oversees other administrative tasks for the office. Madison holds a bachelor's degree from Kansas State University in Education and formerly taught at the high school level. In her free time, she loves adventuring with her husband and cuddling their two cats during movie nights.


A New Licensing System is Coming

Soon, KREC will migrate to a new licensing system! A valid email address is required to ensure licensees receive instructions to register on the new site. Please login to Mylicense E-Gov and follow these instructions to update your email address.

Unfortunately, the original go-live date for November 13, 2024, has been delayed. KREC will provide detailed instruction to applicants, licensees, and educators once the new timeline is finalized. If you have questions, please email krec@ks.gov.

New Features will Include:

  • Online applications: All license applications, company/branch office applications and education provider/course applications will be submitted and tracked entirely online. Application processes have been streamlined to provide a clear and guided user experience and eliminate the need for paper submission.
  • Improved license/record management: Simplified processes for license and company updates, including affiliation changes, online license history certification and individual requests for CE credit. Expanded online capabilities for companies/branches, including online submission of company name changes and trust account updates.
  • Increased accessibility: New system includes Single Account Management allowing brokers to view/manage their own license and access the records for any company/branch office they supervise using one account. Provides online access for course providers, allows for course roster submission and more.
