Is this leadership???

More back story and content regarding the issue at the corner of SE 21st and Adams. While Mr. Henry McClure is a successful long time real estate broker, he is in no way a "property manager" regarding the property in which tenant Mr. Joe McBride resided for many year's. Mr. McClure works with client's, who wish to develop and bring business to an area. While this location is one of his many listings, he went above and beyond to work in the best interest of the tenant. Mr. McClure wrote letters to the owner's of this property and council member Sylvia Ortiz in March 2023. (PDF) provided below. He had been advised Mr. McBride's health wasn't great. He was trying to receive assistance with his whereabouts by and through council member, Sylvia Ortiz. Mr. McClure demonstrated concern when he wrote a letter to Ms. Ortiz and was advised to leave Joe alone. I view her response unprofessional and impedes on Mr. McClure's duty to his client. I dont believe as a citizen this demonstrates a good display of leadership.

In March there was an email and again told to leave Joe alone. I will attach below. Mr. McClure sent an email to city attorney and city clerk regarding that email. While, they may not be legally bound to respond to Mr. McClure, it should serve as documentation of unprofessionalism.

Mr. McClure on April 16, 2024 requested at public comment a request for assistance and help with the dilemma. (Attached youtube below). Never once was the gentleman's name mentioned. Him addressing the city council that evening was for guidance and direction. From there, council member Sylvia Ortiz sent an email stating "strong" inconsistent information. I will attach that at the bottom as well. 

There was a letter sent to owner of this property about water at that residence. At which time, it was found no water had been at the residence for approximately a year for "non payment". According to city code, the residence became "condemned". There was already a court date set for a hearing to have Mr. Joe McBride removed from the property for non payment of rent. It's unfortunate it happened in this manner. I believe it was avoidable had there been help through council member Sylvia Ortiz to assist with resolution and housing for Mr. Joe McBride to include his family as well. His health was at risk too.

Mr. Timothy Hrenchir of Topeka Capital Journal reached out to Mr. McClure regarding the emails for his side. Mr. Hrenchir's article was published and well received by Mr. Henry McClure. I thought the article was informative and helpful. I believe in order to have an understanding of everything, it was essential to provide a bit more and hope it helps with more clarity and transparency.

Mr. McClure not only acted, but wrote with empathy and compassion for Mr. Joe McBride. I hope once you've read through all that's been attached, you will change what may have been put in your mind to think otherwise.

She picks and chooses who to help. 

Telling me "to leave Joe alone" in her capacity of a council person is wrong. 

Tortious interference is a common law tort allowing a claim for damages against a defendant who wrongfully interferes with the plaintiff's contractual or business relationships.

Henry,

      Let's be clear, my job as a council member is NOT to do your dirty work or use my position to remove a disabled old black man from a house that he has been paying rent since 2008 and the owner/landlord did not fulfill his legal obligations and make this property habitable.  But continued to take his money.   Mr. McBride did not get behind on his rent until April of 2024 when he burned himself (burned some toes off) on a wood burning stove, while trying to keep warm because the owners would not fix his heater or water pipes. 

     My only regret is that I did not know this sooner.   Citizens are not happy that you came and publicly blasted Mr. McBride at a council meeting, telling his personal business.

Stop emailing me Henry.   I will never be a part of this unfair treatment to a person who can't defend himself. Stop provoking his son.  Henry Stop the madness!
